Plant Anywhere Standalone Apps

By downloading, installing, or using any standalone application published by Draper Productions LLC ("we," "us," "our," "the Company"), you ("you," "the User") agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the app.
These Terms apply to the following applications and any future standalone apps published by Draper Productions LLC under the Plant Anywhere brand:
Each app may have additional terms set forth in the App-Specific Addenda below (Section 12). Those addenda are part of these Terms.
These apps are published by:
You must be at least 13 years of age to use our apps. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.
We grant you a limited, non-exclusive, non-transferable, revocable license to use our apps for personal, non-commercial purposes, subject to these Terms. You may not:
Some apps are available as one-time paid downloads. Others are free. None of our standalone apps use subscriptions, recurring billing, or in-app purchases. All purchases are processed through Apple's App Store or Google Play and are subject to the respective platform's refund policies.
Most of our standalone apps store data exclusively on your device using local storage (SharedPreferences or equivalent). We do not create user accounts, do not require login, and do not transmit personal data to our servers, except as specifically disclosed in our Privacy Policy and in the App-Specific Addenda below.
Our Privacy Policy, available at plantanywhere.net/standalone-privacy.html, describes our data practices in detail and is incorporated into these Terms by reference.
THE APPS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT:
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DRAPER PRODUCTIONS LLC, ITS OFFICERS, DIRECTORS, MEMBERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, CROP LOSS, ANIMAL LOSS OR INJURY, PROPERTY DAMAGE, PERSONAL INJURY, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
(a) Your use of or inability to use the apps;
(b) Any information, guidance, recommendations, or suggestions provided by the apps, including but not limited to agricultural advice, animal care guidance, pest treatment recommendations, planting timing, composting guidance, and lunar planting suggestions;
(c) Any errors, inaccuracies, or omissions in the apps' content or data;
(d) Any action you take or fail to take based on information provided by the apps;
(e) Unauthorized access to or alteration of your data;
(f) Any other matter relating to the apps.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE APPS EXCEED THE AMOUNT YOU PAID FOR THE APP, OR FIVE DOLLARS ($5.00), WHICHEVER IS GREATER.
Our apps provide educational and informational content about agriculture, animal husbandry, composting, pest management, and planting timing. This information is general in nature and is not tailored to your specific circumstances. You acknowledge that:
You agree to indemnify, defend, and hold harmless Draper Productions LLC, its officers, directors, members, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:
(a) Your use of the apps;
(b) Your violation of these Terms;
(c) Your violation of any rights of any third party;
(d) Any action you take based on information provided by the apps, including but not limited to the application of treatments, chemicals, or medications referenced in the apps.
All content, features, and functionality of the apps, including but not limited to text, graphics, logos, icons, images, audio, software, and data compilations, are the property of Draper Productions LLC or its licensors and are protected by United States and international intellectual property laws.
"Plant Anywhere," "Roost," "Heap," "Moon & Sow," "Pest Patrol," and "When to Plant" are trademarks or trade names of Draper Productions LLC.
We may terminate or suspend your access to any app at any time, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your license to use the app ceases immediately.
The following sections contain additional terms specific to each app. These addenda supplement the general terms above. In the event of a conflict between the general terms and an app-specific addendum, the addendum controls for that app.
12.1.1 No Veterinary Advice. Roost provides general educational information about poultry care and husbandry. Nothing in the app constitutes veterinary advice, veterinary diagnosis, or veterinary treatment. The app is not a veterinary service, and Draper Productions LLC is not a veterinary provider.
You should always seek the advice of a qualified, licensed veterinarian with any questions regarding the health of your animals. Never delay seeking veterinary advice, disregard veterinary advice, or discontinue veterinary treatment because of information provided by this app.
12.1.2 Drug and Medication Information. The app references pharmaceutical products and medications for educational awareness only. Drug names, dosages, and treatment protocols are provided as general reference information, not as prescriptions or recommendations for use. Drug availability, legality, approved uses, and required prescriptions vary by jurisdiction. Always verify drug legality and obtain appropriate veterinary prescriptions in your jurisdiction before administering any medication to animals.
12.1.3 Reportable Diseases. Certain poultry diseases, including Avian Influenza (HPAI) and Newcastle Disease, are reportable to government authorities. If you suspect a reportable disease, contact your state veterinarian, USDA APHIS, or the equivalent authority in your jurisdiction immediately. Do not rely solely on this app for disease identification.
12.1.4 Feed Calculator. Feed calculations are estimates based on general breed averages. Actual nutritional requirements vary by breed, age, climate, activity level, health status, and other factors. Draper Productions LLC does not guarantee the accuracy of feed calculations and is not liable for any harm resulting from reliance on these estimates.
12.2.1 Composting Safety. Heap provides general composting guidance for educational purposes. The app does not guarantee that compost produced following app guidance is safe for any particular use, including application to food gardens.
Improperly composted material may contain pathogens, including E. coli and Salmonella, that can cause serious illness. Users are solely responsible for verifying compost maturity, temperature history, and safety before applying compost to food-producing gardens or any other use.
12.2.2 Material Classifications. Compost material classifications in the app are general guidelines. Material composition and contamination levels vary. Always verify that materials are free of chemical treatments, pesticides, and other contaminants before adding them to your compost.
12.2.3 Temperature and C:N Ratios. Temperature readings and carbon-to-nitrogen ratio calculations are tools to assist your composting process. They are based on user-reported inputs and general reference values. They do not guarantee pathogen elimination or compost quality.
12.3.1 Traditional Practices. Moon & Sow provides gardening suggestions based on traditional lunar planting calendars. These suggestions reflect cultural gardening traditions that have been practiced for centuries. They are not scientific recommendations and have not been conclusively validated by peer-reviewed agricultural research.
Draper Productions LLC makes no claims about the efficacy of lunar planting methods and is not liable for crop outcomes resulting from reliance on lunar planting recommendations.
12.3.2 Supplementary Tool. Moon & Sow is a supplementary planning tool. It does not account for local frost dates, weather conditions, soil conditions, or microclimate variations. Users should always consult local agricultural resources, frost date calendars, and current weather forecasts before making planting decisions.
12.3.3 Informational and Entertainment Purposes. Lunar planting recommendations are provided for informational and entertainment purposes. They should not be relied upon as the sole basis for planting decisions, and they do not replace science-based agricultural guidance.
12.4.1 Automated Identification. Pest Patrol uses machine learning (ML) to identify pests from photographs. ML-based identification is automated and is not guaranteed to be accurate. No AI or ML system achieves 100% accuracy. Misidentifications can and do occur.
Draper Productions LLC is not liable for misidentifications or for any damage, crop loss, environmental harm, or personal injury resulting from treatments applied based on app recommendations.
12.4.2 Treatment Recommendations. Treatment suggestions in the app are general informational guidance only. They are not professional pest management advice. Product availability, legality, and application requirements vary by jurisdiction. Some products may require a pesticide applicator license.
Always read and follow product label directions before applying any pest treatment. Never apply pesticides without understanding their safety requirements, environmental restrictions, and legal status in your area.
Draper Productions LLC does not sell, endorse, or guarantee any pest control product mentioned in the app.
12.4.3 Photo Processing. When you use the camera identification feature, your photo is transmitted to Plant Anywhere's private infrastructure for automated analysis. Photos are processed in real time and deleted immediately after classification. No images are stored on our servers. Only the text classification result is saved locally on your device. See our Privacy Policy for details.
12.4.4 Not Professional Pest Management. This app is not a substitute for professional pest management services. For severe infestations, regulated pests, or any situation involving structural damage or health risks, consult a licensed pest management professional.
12.5.1 Frost Date Data. Planting windows in When to Plant are calculated from historical frost data sourced from the National Oceanic and Atmospheric Administration (NOAA). These are statistical averages based on historical records and do not predict actual weather conditions in any given year.
Frost dates represent approximate probabilities, not guarantees. Late frosts can and do occur after the average last frost date. Early frosts can occur before the average first frost date.
12.5.2 Geographic Coverage. Frost station data is sourced from NOAA and primarily covers locations in the United States. The app may not provide applicable data for locations outside NOAA coverage areas. Draper Productions LLC is not responsible for the unavailability of data for any particular location.
12.5.3 Planting Timing. Planting timing recommendations are general estimates. Actual planting windows vary based on microclimate, elevation, soil type, soil temperature, specific crop variety, and year-to-year weather variation. Following the app's planting schedule does not guarantee a successful harvest.
12.5.4 No Guarantee of Harvest. Many factors beyond planting timing affect crop success, including but not limited to soil quality, water availability, pest pressure, disease, weather events, and gardener experience. Draper Productions LLC is not responsible for crop losses of any kind.
Before filing any formal claim, you agree to attempt to resolve the dispute informally by contacting us at plant@plantanywhere.net. We will attempt to resolve the dispute within 30 days.
If the dispute is not resolved informally within 30 days, you and Draper Productions LLC agree to resolve the dispute through binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, except as modified by this section.
The arbitration shall be conducted in Fairfax County, Virginia, or, at your election, by telephone, videoconference, or based on written submissions.
Either party may bring a claim in small claims court in Fairfax County, Virginia, if the claim qualifies under the court's jurisdictional limits.
For claims under $10,000, Draper Productions LLC will pay all arbitration filing and administration fees. For claims of $10,000 or more, fees will be allocated as determined by the AAA's Consumer Arbitration Rules.
YOU AND DRAPER PRODUCTIONS LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Unless both parties agree otherwise, the arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a representative or class proceeding.
These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia, United States, without regard to its conflict-of-law principles. Any legal action not subject to arbitration shall be brought exclusively in the state or federal courts located in Fairfax County, Virginia.
If any provision of these Terms is held to be unenforceable or invalid, that provision will be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, severed from these Terms. The remaining provisions will continue in full force and effect.
These Terms, together with our Privacy Policy and any app-specific addenda, constitute the entire agreement between you and Draper Productions LLC regarding the use of our standalone apps. These Terms supersede any prior agreements or understandings regarding the subject matter hereof.
We may update these Terms from time to time. We will notify you of material changes by updating the "Effective Date" at the top of this document and, where practical, by providing notice within the affected app. Your continued use of the app after any changes constitutes acceptance of the updated Terms.
These Terms are designed to cover all current and future standalone applications published by Draper Productions LLC. When a new app is added to the portfolio, a corresponding addendum will be appended to Section 12. The general terms (Sections 1-11, 13-17) apply to all apps without modification.
